Tier 5: Resignation Event

What do you do if you missed a compliance, filing, or legal deadline?

The short answer

Tell legal or compliance immediately — before your manager, before the client, before you write a single explanatory message. Regulatory and contractual deadlines often have cure periods, and the window for using them is measured in hours. Preserve every relevant document and do not attempt to backdate, edit, or 'clean up' anything.

What's actually at stake

  • 01Cure provisions and voluntary-disclosure benefits usually depend on speed, which makes delay the expensive part.
  • 02Any alteration of records after the fact converts a missed deadline into misconduct.
  • 03Legal will decide what gets said externally; drafting it yourself creates discoverable material.

Do

  • · Escalate to legal/compliance within the hour.
  • · Preserve all documents and communications as-is.
  • · Write down the factual timeline for internal use.

Don't

  • · Do not backdate or edit anything.
  • · Do not notify the counterparty on your own.
  • · Do not speculate in writing about liability.

A draft you can send now

Flagging urgently: the [filing/notice] due [date] was not submitted. Nothing has been altered and I've preserved the relevant files. I need guidance on notification and next steps before I communicate with anyone outside the team.

Questions people actually ask

Will I be fired?
Far less likely if you escalated immediately. Concealment is what ends careers here.
Should I tell my manager first?
Tell both, but don't let manager availability delay the legal escalation.
Can I fix it quietly?
No. That's the version that becomes the actual scandal.
